Wrongful Dismissal Guide

Employee benefits

What happens to my benefits when I'm fired?

The general measure of damages or loss in a wrongful dismissal claim is the amount that an employee would have received had proper working notice been provided. The assessment of this amount, as well as any severance package, should take into consideration both salary and all other benefits that the employee was receiving throughout their employment, including retirement benefits, like a pension plan, bonus plans, disability benefits, accumulated sick leave, or tuition reimbursements. Calculations will be used to assess the combined value of all benefits over the entire period of reasonable notice.
